Terms of Service

These Terms of Service ("Terms") govern your use of Blog CMS (useblogcms.com), a managed blog publishing platform that lets you write posts and deploy fast, static blogs to your own domain. By creating an account or using the service, you agree to these Terms. If you do not agree, please do not use Blog CMS.

1. Acceptance

By accessing or using Blog CMS, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you use the service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Eligibility and accounts

You must be at least 16 years old and able to form a binding contract to use Blog CMS. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized use.

3. The service

Blog CMS provides tools to write, manage, and publish blog content, and to deploy static blogs to a domain you control. We may add, change, or remove features over time. We aim to keep the service reliable but may perform maintenance or updates that temporarily affect availability.

4. Acceptable use

You agree not to use Blog CMS to create, publish, or distribute content or to engage in activity that:

• Is illegal, infringing, defamatory, harassing, hateful, or harmful.
• Contains malware, or attempts to breach, disrupt, or overload our systems or others'.
• Is spam, deceptive, or used for phishing or fraud.
• Violates the rights or privacy of others.

We may remove content or suspend accounts that violate these rules.

5. Your content

You own your content. You retain all rights to the blogs, posts, pages, images, and other materials you create or upload ("Your Content"). You are solely responsible for Your Content and for having the rights necessary to publish it.

To operate the service, you grant Blog CMS a limited, worldwide, non-exclusive license to host, store, reproduce, and serve Your Content for the purpose of running and providing the service to you and your readers. This license ends when you delete the content or close your account, except for backups retained for a reasonable period or records we must keep by law.

6. Plans and pay-to-publish

Blog CMS offers a 14-day free trial. After the trial, you may continue on a paid plan:

• Yearly — billed at $144 per year.
• Lifetime — a one-time payment for ongoing access, with no recurring charge.

Publishing is pay-to-publish: to deploy a blog you must have an active paid plan or be within your free trial. You can create and edit content at any time, but deployment requires eligible access.

7. Billing, renewals, and refunds

Payments are processed by Stripe; we do not store your full card details. Yearly plans renew automatically at the then-current price unless you cancel before the renewal date. We will charge the payment method on file.

We offer a 14-day refund window for new purchases: if you are not satisfied, contact [email protected] within 14 days of a new purchase and we will refund it. The Lifetime plan is a one-time payment and is also covered by the 14-day window for new purchases; after that period it is non-refundable. Taxes may apply depending on your location.

8. Cancellation and termination

You may cancel your plan or close your account at any time from your account settings or by contacting us. Cancellation stops future renewals; it does not, by itself, entitle you to a refund except as described above.

We may suspend or terminate your access if you breach these Terms, fail to pay, or use the service in a way that harms Blog CMS or others. Where reasonable, we will give you notice and an opportunity to fix the issue. On termination, your right to use the service ends, and we may delete Your Content after a reasonable period.

9. Service provided "as is"

Blog CMS is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or fully secure. You use the service at your own risk.

10. Limitation of liability

To the maximum extent permitted by law, Blog CMS and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Blog CMS and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, your use of the service, or your violation of these Terms or the rights of others.

12. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "last updated" date above and, where appropriate, notify you. Your continued use of the service after the changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Blog CMS operates, without regard to conflict-of-law principles. Any disputes will be subject to the courts of that jurisdiction, unless applicable law grants you the right to bring claims elsewhere.
